Redneck Time

I know I have mentioned a couple of times that I have two gorgeous grandchildren. A 5 year old and a 2 year old.

Well, it seems I am about to become a grandmother again...twice...

My son is in Ohio and his girlfriend there is pregnant. They broke that wonderful news to us a couple of weeks ago.

We would be thrilled except for one small thing..

He isn't divorced from his wife yet (mother of GK #1).

It gets even better. Mother of GK #1 (DIL) just gave birth to a baby boy, not a child by my son. The father of this child is currently a guest of the county for a probation violation.

Because my son and DIL are not divorced, the state of Florida says he is responsible for this new baby, the 1/2 brother of GK #1.

He can't afford the one he has, now he has another one yet to be born and one that isn't his???

I need a drink.

I've heard of this happening before. He can deny paternity; if Child Support Enforcement gets involved, (which they do any time a person applies for state benefits and the children have absent parents. I'm assuming that since her boyfriend is in jail and she just had a baby, she likely is either on benefits or will be soon), they do paternity testing and as long as it's not his child he won't be responsible for paying for the test.

Congrats on the new babies in your life though!

cheekysweetie-I am hoping the paternity testing gets done real soon. She applies for benefits but never completes all the paperwork so they deny her.

can't HE order the pat test, i mean, he is in the clear as far as the results go, so its not like he has anything to lose - also - pretty soon you need ot take the NOT A off your name.. Just sayin'

blue-great so you are saying that because I am so young and wonderful I am a granny??? Yes, he can order it once the state comes after him for child suppoort.

OH yeah. That deserves some wine. That's big news. First of all: CONGRATS!!! seriously. But, I would fight having to pay for the one that's not his. yeeeesh. All will settle down, but in the meantime keep that wine nice and handy.

As part of the divorce, if DIL and her baby daddy sign affidavits that Son is not the dad and Son also agrees that he is not the dad, the judge can declare that Son is not the dad. They don't even have to have the paternity test, so long as everyone agrees. I represented the wife in a similar situation and it was no big. Now if DIL is claiming it is Son's or if baby daddy is denying paternity, it's a different ball game. Then you have to have the test. Son can petition for orders for the test in the divorce case (obviously he will consent to testing, but the judge will need to order it for the baby and the mom - the test is more accurate if they have the mother's DNA as well).
